Please read these terms carefully before using Gumix

1. Acceptance of Terms

By downloading, installing, or using Gumix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Gumix is an AI-powered image generation and editing desktop application. The Service allows users to generate images using text prompts, edit images, remove backgrounds, and collaborate with team members.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription Plans

Free Tier (BYOK)

The free tier requires you to provide your own Google Gemini API key. You are responsible for any costs incurred through your API usage with Google.

Paid Plans

Paid subscriptions (Pro, Max, Team) are billed monthly or annually. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate illegal, harmful, or offensive content
  • Create content that infringes on intellectual property rights
  • Generate deepfakes or non-consensual imagery of real people
  • Produce content depicting minors inappropriately
  • Spam, harass, or abuse others
  • Circumvent security measures or access restrictions
  • Reverse engineer or decompile the software
  • Use the Service for any illegal purpose

6. Content Ownership

Your Content

You retain ownership of images you create using Gumix. You grant us no rights to your generated content.

AI-Generated Content

Images generated through AI may be subject to the terms of the underlying AI model (Google Gemini). You are responsible for ensuring your use of generated content complies with applicable laws and third-party rights.

7. Intellectual Property

Gumix, including its software, design, and branding, is owned by us and protected by copyright and trademark laws. You may not copy, modify, or distribute the software without permission.

8. Third-Party Services

The Service integrates with third-party services including:

  • Google Gemini: For AI image generation
  • Stripe: For payment processing
  • Supabase: For authentication and data storage

Your use of these services is subject to their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may cancel your account at any time through the dashboard settings.

12. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
